While Alimony was originally awarded based on the courts discretion and usually on a case by case basis, New York State currently determines alimony using a fixed formula based on spousal incomes. A percentage of both incomes. Post- divorce alimony is determined by factors such as the income of both spouses, length of marriage, children, insurance lost due to divorce and any other relevant factors determined by a court.
