What is the difference between DWI and DUI?

  • November 20, 2017

What is the difference between DWI and DUI? Both DUI and DWI refer to the illegal act of driving a vehicle while impaired by alcohol and/or drugs. The main difference is one means, Driving Under the Influence and the other means Driving While Intoxicated…It is hard to notice the difference, but there is one. DUI is a lesser level of impairment (under 0.08 percent),  the legal limit. The blood alcohol content (BAC) is higher with a DWI (above 0.08 percent), the legal limit.

In New York State, we have DWI and DWAI, DWAI means that the driver’s BAC is between 0.05 and 0.07 percent.
